Terms of Service

1. Definitions

  • Sitebite: the online service offered by Octo B.V. (KvK 75365650), trading as Sitebite, based at Nieuwe Teertuinen 23, 1013 LV Amsterdam, the Netherlands.
  • Service: the Sitebite platform, including the dashboard, the website builder, hosting, domain management and all associated features.
  • User: any natural or legal person who creates an account with Sitebite.
  • Account: personal access to the Service, secured with login credentials.
  • Website: a website created and managed by the User through the Service.
  • Subscription: paid access to the Service for a specified period.
  • Organisation: a group within Sitebite to which Users and Websites are linked.

2. Applicability

2.1. These terms and conditions apply to all use of the Service and to every agreement between Sitebite and the User.

2.2. By creating an account or using the Service, you agree to these terms.

2.3. Deviations from these terms are only valid if agreed in writing.


3. The Service

3.1. Sitebite is an online platform that lets hospitality businesses easily build and manage a professional website, including features for menus, opening hours, bookings, forms and more.

3.2. Sitebite offers, among other things, the following features:

  • Visual website builder with templates and sections
  • Menu management with optional AI analysis
  • Form builder with submission management
  • Media library for images and videos
  • SEO tools and search engine access
  • Integrations with external services (booking systems, marketing tools, analytics)
  • Multilingual support (Dutch, English, German, French, Spanish)
  • Connecting your own domain name
  • Team management within organisations

3.3. Sitebite reserves the right to add, change or remove features, provided this does not materially limit the core functionality of the Service.


4. Account and registration

4.1. To use the Service, you must create an account. This can be done using an email address with a password, or via Google OAuth.

4.2. You are responsible for keeping your login credentials confidential and for all activities carried out through your account.

4.3. You must provide accurate and current information when registering and keep it up to date.

4.4. You can invite team members to your Organisation. You are responsible for managing access rights within your Organisation.


5. Subscriptions and payment

5.1. Publishing a website through Sitebite requires a paid subscription. Current prices and available subscriptions can be found on our website and in the dashboard.

5.2. Subscriptions can be taken out monthly or annually. For an annual subscription, the full annual amount is invoiced in one go.

5.3. All stated prices are exclusive of 21% Dutch VAT, unless stated otherwise.

5.4. Payments are processed via Mollie. Available payment methods include iDEAL and credit card.

5.5. After the first payment, the subscription is automatically renewed for the same period. Payment is taken automatically via the payment method registered with Mollie.

5.6. Sitebite reserves the right to adjust its prices. Price changes are announced at least 30 days in advance. In the event of a price increase, you have the right to cancel your subscription before the change takes effect.

5.7. Invoices are generated automatically after payment and sent by email to the billing email address provided. Invoices are also available in the dashboard.

5.8. Discount codes may be applied when taking out a subscription, subject to the terms stated for the relevant promotion.


6. Content and intellectual property

6.1. All content you create, upload or enter through the Service (text, images, menus, videos, etc.) remains your property.

6.2. By posting content through the Service, you grant Sitebite a limited licence to use that content to the extent necessary to provide the Service (storing, displaying, optimising and distributing your website).

6.3. The Sitebite platform, including software, design, templates and documentation, is and remains the property of Octo B.V. It is not permitted to copy, modify or reverse-engineer the software or any part of it.

6.4. The templates and standard designs offered by Sitebite may only be used in combination with the Service.


7. AI features

7.1. Sitebite offers AI-powered features, including analysing menus, generating website text and SEO analysis.

7.2. AI-generated content is provided for support and inspiration. Sitebite makes no guarantee as to the accuracy, completeness or suitability of AI-generated content.

7.3. You are responsible for reviewing and approving AI-generated content before it is published on your website.

7.4. To provide AI features, data is processed by external AI providers (such as OpenAI and Anthropic). Only the content you have entered or uploaded is shared, no personal account data. See our privacy policy for more information.


8. Third-party integrations

8.1. Through Sitebite you can activate integrations with third-party services, including but not limited to booking systems (Formitable, Resengo, Zenchef and others), marketing platforms (MailChimp, Klaviyo, ActiveCampaign), analytics services (Google Analytics, Hotjar) and cookie solutions (Cookiebot, CookieYes).

8.2. Use of third-party integrations is subject to the terms and privacy policy of the relevant third party. Sitebite is not responsible for the functioning, availability or data processing of these external services.

8.3. You are responsible for correctly configuring integrations and for complying with applicable laws and regulations (including the GDPR) when using these integrations on your website.


9. Use of the Service

9.1. You use the Service solely for lawful purposes and in accordance with these terms.

9.2. It is not permitted to:

  • Use the Service for unlawful, misleading or harmful content
  • Circumvent or disrupt the security of the Service
  • Use the Service in a way that negatively affects its operation for other users
  • Deploy automated systems (bots, scrapers) without prior written permission

9.3. Sitebite reserves the right to remove content or block accounts in violation of these terms, without prior notice.


10. Availability

10.1. Sitebite strives for the highest possible availability of the Service, but cannot guarantee 100% availability.

10.2. Sitebite may temporarily interrupt the Service for maintenance, updates or security measures. We aim to do this outside peak hours and to inform you in advance where possible.

10.3. Sitebite is not liable for damage resulting from temporary unavailability of the Service.


11. Liability

11.1. Sitebite makes every effort to provide the Service as well as possible, but accepts no liability for:

  • Indirect damage, consequential damage, loss of profit or lost revenue
  • Damage resulting from inaccuracies in AI-generated content
  • Damage caused by the use of third-party integrations
  • Damage resulting from unauthorised access to your account due to negligence in protecting your login credentials

11.2. Sitebite’s total liability is, in all cases, limited to the amount you have paid to Sitebite in the 12 months preceding the event giving rise to the damage.

11.3. The limitations in this article do not apply to the extent that mandatory law prevents this.


12. Termination

12.1. You can cancel your subscription at any time via the dashboard. The subscription continues until the end of the current billing period.

12.2. At the end of your subscription, your website is taken offline. Your content remains available for a reasonable period so you can export it or reactivate your subscription.

12.3. You can delete your account via the dashboard. Account deletion is not possible while you have an active subscription or an ongoing payment mandate. Upon account deletion, your personal data is deleted in accordance with our privacy policy.

12.4. Sitebite may suspend or terminate your account in the event of a breach of these terms or prolonged non-payment, after having informed you.


13. Privacy

13.1. The processing of personal data is governed by our privacy policy. The privacy policy forms an integral part of these terms.


14. Changes

14.1. Sitebite may amend these terms from time to time. In the event of material changes, you will be notified at least 30 days in advance by email or via a notification in the dashboard.

14.2. By continuing to use the Service after the effective date of amended terms, you agree to the amended terms. If you do not agree, you can cancel your subscription before the change takes effect.


15. Governing law and disputes

15.1. These terms and all agreements between Sitebite and the User are governed by Dutch law.

15.2. Disputes are preferably resolved through mutual consultation. If that is not possible, disputes will be submitted to the competent court in Amsterdam.
